CUSTOMER: The Supreme Court of the Republic of Belarus.

Automated information courts system of the general jurisdiction of the Republic of Belarus (further - AIS CGJ) provides complex automation of the courts system activities of general jurisdiction:

• The Supreme Court of the Republic of Belarus;
• Regional (Minsk city) courts, economic courts of the Minsk regions;
• District (city) courts.

AIS CGJ gives the ability to maintain a unified database, located in a geographically distributed disaster-proof data center. The system provides:

• automation of the main processes related to judicial activity;
• improving the quality and reliability of the processed information;
• one-time entry and multiple use of information, necessary for the functioning of the general jurisdiction courts system of;
• minimizing the time spent, searching and receiving information;
• operational monitoring of the proceedings progress;
• integration of audio, video recordings, logging with electronic cases;
• modern communication interaction between employees, departments, courts, and also between AIS CGJ and diverse state automated systems and data banks;
• improving the efficiency of staff management;
• technology optimization and workflow system improvement, making conditions for the transition to electronic document management;
• strategic formation of a variety of output documents, including statistical reports for a specific court or region;
• authorized access to the functions of automated system and data, processed in it;
• information security level as required the current legislation of the Republic of Belarus.

The main subsystems of AIS CGJ:

Subsystem of general clerical work (document management)

Main functions:
• registration of incoming documents of a general character (including plans, letters, certificates, information notes, summaries, reviews, copies of court orders, etc., coming from the courts);
• registration of the appeals of citizens and legal entities;
• registration of documents for the study and generalization of judicial practice (requests, programs, final documents, publications);
• registration of cases, filed under the procedural legislation, for the study and generalization of judicial practice, at the oral request of the court management (a separate record card for each case);
• registration of materials, documents that are subject to consideration by the Plenum, the Presidium of the Supreme Court of the Republic of Belarus, the Scientific Advisory Board under the Supreme Court of the Republic of Belarus, as well as their decisions and protocols;
• registration of documents and materials, disciplinary proceedings to be considered by the Higher Qualification Collegium of Judges of the Supreme Court of the Republic of Belarus as well as protocols, representations, decisions, conclusions, certification sheets;
• registration of incoming electronic documents received via secure email of state bodies and “Mailgov” organizations from the interdepartmental workflow system (further - IWS), from the unified information system for the control of execution orders (further - UIS CEO) of the Republican Unitary Enterprise “National Center for Electronic Services”, electronic documents received via departmental communication between vessels of the AIS CGJ;
• registration of outgoing documents, including electronic documents, sent by government bodies and organizations "Mailgov" via secure email to the IWS, to the UIS KVP of the Republican Unitary Enterprise “National Center for Electronic Services”, electronic documents originating from departmental communications between the ships of the AIS CGJ;
• registration of internal documents;
• sending documents for consideration, execution, sighting with the formation of relevant instructions (appeals), the formation of messages to users to whom documents are sent;
• statement of documents (instructions) for control, removal them from it;
• execution of instructions (appeals), the formation of messages to users, who created an order (an appeal);
• receiving postal numbers of departures by outgoing correspondence, sent via registered mail (due to the interaction with the software product “Batch mail” of the Republican Unitary Enterprise “Belposhta”);
• formation and transfer of the electronic mail correspondence register to the Program product “Batch mail” of the Republican Unitary Enterprise “Belposhta”;
• attaching electronic documents (incoming, outgoing, internal) to the registration card, storing them in the database system with protection from users, making changes to the text, with the exception of the individual who prepared the document and agreed the changes with an official, affixing an electronic signature;
• search for documents, instructions, registration, control cards according to different criteria, including search by implemented filters (lists);
• protection of generated registries in the system database;
• use of electronic digital signature.

Subsystem of staff management

Main functions:
• maintaining electronic cards of the T-2 form;
• formation of staffing table;
• maintaining an electronic time sheet;
• calculation of the vacation dates;
• calculation of the duration of the vacation;
• calculation of work experience for a specific date, determined by the user;
• processing (registration) of orders for core activities, staff, formed outside the automated system;
• search for information in the database according to the specified criteria, including by implemented filters.

Generation of messages about:
• approaching of expiration contracts dates;
• the expiration dates of the judges powers (including retirement, reaching the age limit for being in the public service);
• approaching of the expiration date of the tenure of judges in compliance with qualification class;
• approaching the expiration date of tenure of civil servants in the appropriate class of civil servant;
• approaching the date of transfer of a civil servant from one probationary group to another for establishing the appropriate bonus for seniority;
• approaching the date of providing work leave to employees;
• the need for carrying out the certification of civil servants;
• the onset of holidays, birthdays is carried out using the subsystem of forming and processing messages.

Subsystem of mail interaction

Main functions:
• creating and editing messages;
• attachment to messages of files (not less than 20);
• receiving / transmission of messages;
• work with draft messages;
• viewing lists of incoming and outgoing messages as well as drafts;
• the ability to create a system, necessary for its distribution group by any user.

Subsystem of audio, video recording, logging and video conferencing

Main functions:
• registration of users and differentiation of access rights;
• setup of standard protocol templates for court hearings and reference books of procedural actions;
• maintaining of a court hearings schedule;
• management of the process of audio, video recording of the court hearing;
• audio, video broadcast in real time mode;
• formation of the court record by the secretary;
• transfer of the court record from the secretary to the judge;
• verification and signing of the court trial records by a judge;
• control of the time preparation of court records;
• search for audio, video, and court records;
• export and import of audio, video and court records;
• logging of users subsystem actions.

Subsystem for creating and printing passes

Main functions:
• formation (order) of a pass to enter the courthouse by the employee to whom the visitor came, or by an employee who possess the appropriate rights, storing information in the database;
• creation of passes for a certain period;
• search for a pass by various criteria (surname, name, patronymic, date, etc.).

Subsystem of maintenance of reference books and classifiers

Main functions:
• maintenance of system classifiers having a standard, unified structure (gender, nationality, type of document, etc.);
• maintenance of system classifiers having a unique structure (settlement accounts of business entities, production calendar, etc.);
• organization of subordinate relationships between records of one or various classifiers having a standard, unified structure - for providing control over the input of dependent concepts, creating a convenient user interface;
• maintenance of system directories;
• maintenance of borrowed classifiers and reference books: receipt and processing changes, received from external automated systems, which include the relevant classifiers, reference books.

Subsystem of applied management

Main functions:
• management of user accounts (creation, editing, blocking (including automatic - when exceeding the specified number of failed authorization attempts), unlocking (including automatic - after the specified lock time expires, performed after failed authorization attempts), search);
• management of users rights to functions, implemented in an automated system;
• management of users rights on access to information, processed in the automated system (taking into account the court in which the user works, the position of the user, whether the data has restrictions on access to them, data status);
• management of user roles;
• change of password by the user (the function is available to any user of the system after their authorization);
• logging user actions and system events.

Role management provides:

• creating a new role, assigning a set of functions to it;
• adjustment of the role name, the composition of the functions assigned to it;
• removing of a role together with its functions;

Subsystem "Population Register" interacts with the national information system "Population Register" of the Ministry of Internal Affairs in terms of obtaining information and transmitting data.

Subsystem “Access to Databases of Government Bodies” interacts with the databases of the following government bodies: Ministry of Justice, Ministry of Economy, Ministry of Internal Affairs, Ministry of Taxes and Duties, Investigative Committee, State Customs Committee, Automated Systems of Mobile Operators, RUE “Belposhta".

Subsystem “Module of the IWS work with the NCEEU” interacts with the IWS of the Republican Unitary Enterprise “National Center for Electronic Services”.

Subsystem “Exit Restriction” interacts with a data bank on citizens whose right to leave the Republic of Belarus is temporarily limited in terms of transferring information about citizens whose right to leave the Republic of Belarus is temporarily limited.

Subsystem “Criminal proceedings”

Main functions:
• registration and accounting of proceedings in criminal cases, on compensation for damage due to newly discovered circumstances; in the courts of the first, supervisory and appeal instances; on compensation for damage, caused to an individual or legal entity by illegal actions of the body, conducting the criminal proceedings; in criminal cases of private prosecution; due to newly discovered circumstances; in criminal cases on the application of coercive measures of security and treatment; in criminal cases in relation to certain categories of individuals;
• registration of materials on parole from punishment and replacing the unserved part of the punishment in a softer way due to disease; on changing the conditions of detention of individuals, convicted to deprivation of liberty while serving a punishment; on the cancellation of the probation, on the cancellation of the delay in the execution of sentences; on the removal of a criminal record; the replacement of correctional labor with fine, public works and other materials;
• registration and accounting of complaints about decisions on choosing a preventive measure (on extanding of the period of detention);
• registration of applications for rehabilitation (for the Supreme Court of the Republic of Belarus); pardon materials; adaptation materials; complaints of individuals against decisions on extradition to a foreign state (extradition);
• registration of requests of foreign competent authorities for the provision of international legal assistance in criminal proceedings; requests of courts of general jurisdiction of the Republic of Belarus to foreign competent authorities for the provision of international legal assistance in criminal proceedings;
• registration of incoming procedural appeals as part of the consideration of cases and the results of their consideration in order to take into account the real burden on judges;
• the formation and maintenance of a time sheet for the work of lay assessors;
• registration of permits, issued for visits with detainees;
• receiving and transmitting information on criminal cases to the Ministry of Internal Affairs of the Republic of Belarus;
• filling in information on execution through interaction with the automated information system of the Ministry of Justice of the Republic of Belarus, a unified state data bank of the Department for the Execution of Sentences of the Ministry of Internal Affairs;
• formation of reports for criminal proceedings;
• formation of logs of accounting, registration, reclaims for criminal proceedings.

Subsystem “Administrative proceedings”

Main functions:
• registration and accounting of information on the consideration of a case of an administrative case; on consideration of a complaint (protest) against a ruling on an administrative offense that has not entered into legal force; on consideration of a complaint (protest) against an administrative case, which came into force in the case of an administrative offence; on execution (issuing a decision in an administrative case, sending a decision in an administrative case for execution, filing an administrative case in the archive);
• registration of incoming procedural appeals as part of the consideration of cases and the results of their consideration by type of productions in order to take into account the real burden on judges.
• registration of applications for the return of confiscated items to an individual, subjected to an administrative penalty;
• filling in performance details through interaction with the automated information enforcement system of the Ministry of Justice of the Republic of Belarus;
• receiving and transmitting information on cases of administrative offenses through interaction with a Unified Data Bank on Offenses of the Ministry of Internal Affairs of the Republic of Belarus;
• formation of reports for proceedings in cases of administrative offenses;
• formation of logs of accounting, registration, reclamation for proceedings on cases of administrative offenses.

Subsystem "Civil proceedings"

Main functions:
• registration and accounting of claims; proceedings in cases arising from administrative legal relations; special production; ordered proceedings; cases filed to determine jurisdiction; proceedings in the court of appeal; proceedings in the court of cassation instance; production of cases in the court of supervisory instance; submissions of lower courts in the supervisory courts; submissions of the President (or Vice-President) of the Supreme Court of the Republic of Belarus to lower courts; proceedings for the review of court rulings on newly discovered circumstances; proceedings on the application for cancellation of the arbitration court; proceedings on the application to cancel the decision of the labor arbitration; enforcement proceedings; proceedings on recognition and enforcement of decisions of foreign courts.
• registration and accounting of received applications left without movement, and applications for which initiation of proceedings is refused; registration of incoming procedural appeals as part of the consideration of cases and the results of their consideration in order to take into account the real burden on judges; applications for permission to enforce decisions of foreign courts; objections of the interested individual against the recognition of a decision of a foreign court; instructions of foreign courts on the execution of certain procedural actions in civil cases; instructions of the courts of general jurisdiction of the Republic of Belarus to foreign courts with instructions on the execution of certain procedural actions in civil cases;
• interacting with a data bank on citizens of the Republic of Belarus whose right to leave the Republic of Belarus is temporarily limited;
• implementation of the receipt and transmission of data to the population register;
• formation of reports for civil proceedings;
• formation of logs of registration, registration, demand for civil proceedings.

Subsystem “Legal Proceedings on Intellectual Property Cases”

Main functions:
• registration and accounting of claims; proceedings in cases arising from administrative legal relations; supervisory review of cases (registration of supervisory-complaints considered without and with the reclamation of cases, protests, cases in the Presidium, Plenum of the Supreme Court of the Republic of Belarus);
• registration of foreign courts instructions on the performance of certain procedural actions; registration of courts instructions of general jurisdiction of the Republic of Belarus to foreign courts with instructions on the performance of certain procedural actions;
• formation of reports for proceedings on intellectual property cases;
• formation of registration and accounting logs for legal proceedings in intellectual property cases.

Subsystem "Economic proceedings"

Main functions:
• registration and accounting of economic cases of lawsuit; clerical proceedings; proceedings on cases of economic insolvency (bankruptcy); proceedings on the recognition and enforcement of decisions of foreign courts and foreign arbitral awards; proceedings on appeals against decisions of international arbitration courts, arbitration courts, other permanent arbitration institutions located on the territory of the Republic of Belarus;
• registration and accounting of the revision of court decisions that have entered into legal force due to newly discovered circumstances; instructions of foreign courts and competent authorities of foreign states on the commission of certain procedural actions; courts instructions that consider economic cases to foreign courts and competent foreign states authorities about the commission of certain procedural actions; enforcement proceedings;
• registration of incoming procedural appeals as part of the consideration of cases and the results of their consideration by type of proceedings in order to take into account the real burden on judges;
• interaction with a data bank on citizens of the Republic of Belarus whose right to leave the Republic of Belarus is temporarily limited;
• formation of reports for economic proceedings;
• formation of logs of accounting, registration, reclamation and transfer for economic proceedings.

Subsystem “Generalization of judicial practice”

Main functions:
• registration and accounting of cases received for the study and generalization of judicial practice;
• registration and accounting of cases received under the procedural legislation at the verbal requests of court leaders;
• formation of logs and reports for subsystem of generalization of judicial practice.
